NEW YORK (AP) — President Joe Biden will nominate Christy Goldsmith Romero to replace Martin Gruenberg as head of the Federal Deposit Insurance Corporation.

The announcement from the White House on Thursday came after Gruenberg’s tenure became marred by allegations of workplace abuse that led to him to resign.

A longtime financial regulator, Goldsmith Romero is currently a commissioner at the Commodity Futures Trading Commission, the nation’s financial derivatives regulator. She previously worked with the Department of Treasury and was part of the team that handled the Troubled Asset Relief Program, which lent $700 billion to troubled banks during the 2008 financial crisis. She also is a law professor at Georgetown University.

Her previous nominations to the nation’s financial regulators were unanimously confirmed by the Senate.

“She has proven herself to be a strong, independent, and fair regulator who is not afraid to do what’s right,” said Sen. Sherrod Brown, D-Ohio and chair of the Senate Banking Committee, in a statement.

Gruenberg last month said he would resign from the FDIC, after an independent report by law firm Cleary Gottlieb Steen & Hamilton found incidents of stalking, harassment, homophobia and other violations of employment regulations, based on more than 500 complaints from employees.

Complaints included a woman who said she was stalked by a coworker and continually harassed even after complaining about his behavior; a field office supervisor referring to gay men as “little girls;” and a female field examiner who described receiving a picture of an FDIC senior examiner’s private parts.

Republicans have been calling for Gruenberg to step down since the allegations emerged late last year. The White House and Gruenberg resisted those calls partly because the FDIC is led by a five member board, and his resignation would pass control of the agency to the FDIC’s vice chair, who is a Republican. Gruenberg’s resignation would not be official until Goldsmith Romero nomination is finalized.

“FDIC employees deserve a safe workplace that allows them to focus on their important mission to safeguard our country’s financial security. Unfortunately, under the leadership of Chairman Gruenberg, that hasn’t been the case,” said Sen. Tim Scott, the ranking Republican on the Banking Committee, in a statement.

The FDIC is one of several U.S. banking system regulators. The Great Depression-era agency is best known for running the nation’s deposit insurance program, which insures Americans’ deposits up to $250,000 in case their bank fails.

WASHINGTON (AP) — The military’s hundreds of V-22 Ospreys will not be permitted to fly their full range of missions until at least 2025 as the Pentagon addresses safety concerns in the fleet, the head of the program told lawmakers at a hearing Wednesday.

Vice Adm. Carl Chebi, head of U.S. Naval Air Systems Command, which has responsibility for the aircraft military-wide, told lawmakers at a House oversight hearing into a series of recent crashes that it will be at least another six to nine months before the command will be able to complete all of the safety and performance assessments for the Osprey.

Over the lifespan of the program, Chebi said a total of 64 service members have been killed in air and ground accidents, and 93 have been injured. In the last two years, four separate crashes killed a total of 20 service members, and two of those crashes involved catastrophic materiel or mechanical failures the program had not experienced before.

Following a November crash off the coast of Japan that killed eight service members, the fleet was grounded for months. The Ospreys started flying again in a very limited format in March and do not perform the full range of missions, including carrier operations, that the aircraft was made to carry out.

In use since only 2007, the Osprey can fly like an airplane and land like a helicopter. Critics say its innovative design has systemic flaws that are driving the unexpected failures.

One of the reasons for the extension of restricted flight: The military is still working to fix a clutch failure that was identified as one of the primary factors in a June 2022 crash that killed five Marines in California.

The clutch component, like many other parts of the aircraft, has been wearing out far faster than expected. This led to an unprecedented dual hard clutch engagement in the 2022 crash, creating a situation in which the pilots had no way to save the aircraft.

The military has not yet said what exact part failed in the November crash, but Chebi told the panel Wednesday that the cause was something “we’d never seen before.”

Rep. Stephen Lynch, a Massachusetts Democrat, told Chebi to reground the entire fleet until all safety issues were fixed.

“What do you think the consequences will be if we have another V-22 go down and we lose more brave Marines or Airmen between now and the time?” Lynch said. “Your whole program’s done. It’s done. If another Osprey goes down, we’re done. This program’s done. So why don’t we ground this now?”

Families of service members killed in Osprey accidents sat behind Chebi as he testified. Each held a photograph of their family member killed, and after the hearing, he stayed to listen as they told him their concerns.

“We’re afraid that they’re aging out, and now we are having all these crashes,” said Bart Collart, whose son Marine Corps Cpl. Spencer Collart was killed in a 2023 Osprey crash off the coast of Australia.

The committee is looking into whether the program has adequate oversight, but to date, it has not received the data and documents it has requested, members said at the hearing.

Among the information that the House Oversight Committee’s Subcommittee on National Security, the Border and Foreign Affairs has requested but has yet to receive is the wear and replacement rates on Osprey proprotor gearboxes, a component that was a factor in the crash off Japan.

Committee members also have asked for internal crash reports that the military conducts with surviving air and ground crews and witnesses. The reports aren’t available to the public and cannot be used to punish a crew — they are in place to identify and quickly share any safety issues among the fleet.

To date, the staffers said they had received about 3,500 pages of documents, but information was redacted, leaving them unable to conduct oversight. The committee staffers spoke on the condition of anonymity to discuss sensitive matters.

The staffers said the documents they have reviewed left them concerned about whether Pentagon leadership has maintained a close watch on the Osprey program. Some of the problems with the aircraft date back a decade or more but still haven’t been fixed.

After mechanical and material failures led to the 2022 Osprey crash in California, the military said it had instituted changes to prevent the issue from happening again.

“However, the recent fatal crash and ongoing investigations suggest that more transparency and rigorous testing is needed to verify these claims,” Rep. Glenn Grothman, a Wisconsin Republican who chairs the committee, said in a statement to the AP ahead of the hearing.

The Marine Corps is planning on using the Osprey through 2050, while Air Force Special Operations Command has already begun to talk publicly about finding another type of aircraft to conduct missions.

Osprey producers Bell Flight, the Boeing Co. and Rolls-Royce, which supplies the engines, are facing a new lawsuit from families of the five Marines killed in the 2022 California crash. The lawsuit alleges that the companies did not address known parts failures or safety issues that were a factor in the crash.

Boeing and Bell have declined to comment, citing the ongoing litigation.

The staffers say the Pentagon has not provided details on what the restrictions are as the aircraft returns to operations.

TWIN FALLS, Idaho (AP) — The federal Bureau of Land Management’s preferred alternative for a proposed large-scale wind energy farm in southern Idaho would shrink its size by nearly half and move it farther from a national historic site.

The proposed Lava Ridge wind farm has drawn opposition from government leaders, local ranchers, and people who have said, among other things, that the project endangers the Minidoka National Historic Site, where Japanese Americans were detained during World War II.

The agency detailed its preferred alternative to the original plan in its final environmental review released last week. It would decrease the number of wind turbines to 241 from 400 and cap the maximum height of the electricity-generating turbines at 660 feet (201 meters), KTVB-TV reported.

The plan also places the closest turbine to the historic site at 9 miles (14 kilometers) away. The agency said adjusting the corridor configuration aims to help “preserve the visitor experience of the remote nature of the former incarceration site.”

As proposed in 2020, it would have been built within about 2 miles (3.2 kilometers) of the visitor center for the historic site. Nonprofit organization, Friends of the Minidoka, is one group that has been concerned the project could destroy the the experience they want to preserve at the site.

Robyn Achilles, the organization’s executive director, said in a statement that most of the detailed historical research provided by the group to the Biden administration to enable them to better protect the historic site was disregarded in this decision.

The Biden administration “needs to do a better job and make a real commitment to protect Minidoka and our heritage, or we will be dealing with Lava Ridge and other projects forever,” Achilles said.

Idaho Republicans U.S. Rep. Mike Simpson and U.S. Sen. Jim Risch both expressed their continued opposition to the project in social media posts last week.

Risch said he would continue to fight what he called an “unnecessary and ill-begotten project.”

The Biden Administration has prioritized permitting renewable energy projects on public lands by 2025 as part of its response to climate change. Magic Valley Energy, which is a subsidiary of New York-based LS Power, proposed the Lava Ridge energy project and has said it would increase economic activity in the area in part by creating jobs and increasing local government tax revenues.

Luke Papez, senior director of project development for LS Power, said in a statement that the agency’s new preferred alternative appears to strike an appropriate balance between the protection of environmental resources and the need for additional domestic energy production.

The Bureau of Land Management released its draft environmental impact statement in early 2023 with two preferred alternatives. A 90-day comment period then generated more than 11,000 public comments and 1,400 scoping comments, officials said.

The final environmental review’s preferred alternative decreases the “area disturbed” by nearly 50%, from 8,395 acres to 4,492 acres (3,397 hectares to 1,817 hectares).

“The preferred alternative also reduces potential impacts to sage grouse, large wildlife migration routes and winter concentration areas, cultural resources, Jerome County Airport and agricultural aviation uses, public land ranchers, and adjacent private landowners,” BLM’s news release said.

If the new preferred alternative is selected, BLM estimates the project’s construction to generate $21.9 million in tax revenue annually and contribute $138.9 million in total economic output.

The BLM said the preferred alternative was created through engagement with landowners, ranchers, Tribal Nations, federal, state and county elected leaders, organizations, the BLM’s Resource Advisory Council for the area and the National Park Service.

Without any changes, the Bureau of Land Management’s preferred alternative would be finalized in July.

WASHINGTON (AP) — A retired four-star admiral who was once the Navy’s second highest ranking officer was arrested Friday on charges that he helped a company secure a government contract for a training program in exchange for a lucrative job with the firm.

Robert Burke, who served as vice chief of naval operations, faces federal charges including bribery and conspiracy for what prosecutors allege was a corrupt scheme that led to the company hiring him after his retirement in 2022 with a starting annual salary of $500,000. He oversaw naval operations in Europe, Russia, and most of Africa.

Also charged in the case are Yongchul “Charlie” Kim and Meghan Messenger, who are co-chief executive officers of the company. The company is not named in court papers, but Kim and Messenger are named as the CEOs on the website for a company called NextJump, which provides training programs.

“The law does not make exceptions for admirals or CEOs. Those who pay and receive bribes must be held accountable,” said Matthew Graves, the U.S. attorney for the District of Columbia. “The urgency is at its greatest when, as here, senior government officials and senior executives are allegedly involved in the corruption.”

Burke, 62, of Coconut Creek, Florida, made his initial appearance in Miami on Friday but didn’t enter a plea during the hearing, according to defense attorney Timothy Parlatore. The lawyer said Burke will plead not guilty and intends to clear his name at trial.

“I think a jury will see through this,” Parlatore said.

Burke conditionally retired from the Navy on July 31, 2022. Senior officers will often conditionally retire if there are administrative matters pending.

Rear Adm. Ryan Perry said the Department of the Navy has fully cooperated with the investigation.

“We take this matter very seriously and will continue to cooperate with the Department of Justice,” Perry said in a statement.

Kim and Messenger’s company provided a workforce training pilot program to a component of the Navy from August 2018 through July 2019. The Navy terminated the pilot program in late 2019 and directed the company not to contact Burke.

But the two company executives arranged to meet with Burke in Washington, D.C., in July 2021. During the meeting, Kim and Messenger proposed that Burke use his Navy position to steer them a contract in exchange for future employment at the company, the indictment alleges.

In December 2021, Burke ordered his staff to award a $355,000 contract to train personnel under Burke’s command in Italy and Spain, according to the indictment. Burke began working at the company in October 2022.

Parlatore noted that the value of that contract was smaller than Burke’s starting salary.

“There was no connection between this contract and his employment.” Parlatore said. “The math just doesn’t make sense that he would give them this relatively small contract for that type of a job offer.”

WASHINGTON (AP) — The top-ranking Republican on a Senate committee that oversees the military is calling for a “generational investment” in America’s defense, saying aggressive and significant spending increases are necessary to deter coordinated threats from U.S. adversaries such as Russia, Iran and China.

Sen. Roger Wicker told The Associated Press that he will seek an additional $55 billion in defense spending over the limits that were forged in the deal to suspend the nation’s debt limit a year ago. Wicker explained his position in global terms, saying there has “never been such a level of cooperation and coordination among an axis of aggressors” that aims to challenge U.S. dominance.

The plan lays down a significant marker for Senate Republicans as they enter into a new round of budget fights with Democrats in the heat of a closely fought election year. The White House has proposed $850 billion in defense spending, adhering to the debt limit deal by proposing a 1% increase from the previous year. That plan is unlikely to keep pace with inflation and would seek to reduce the military’s costs by retiring older ships and aircraft.

Wicker acknowledged it would be “a hill to climb” to convince Congress to break from the spending caps at a time of deep political upheaval. Washington is still grappling with divisions over support for Ukraine, the aftershocks of two long wars in Iraq and Afghanistan and a presidential election between two presumptive candidates — Biden and Republican Donald Trump — who espouse vastly different visions of America’s role abroad.

But Wicker, R-Miss., said the U.S. has no choice. “We would be very foolish on a national survival basis to adhere to that when it comes to national defense,” said Wicker, the ranking member on the Senate Armed Services Committee.

While GOP defense hawks have long advocated for robust defense spending, Wicker’s plan goes a step further, calling for a broad shift in the U.S. defense posture that would amount to a reshuffling of national priorities. Under his proposal, the military would eventually consume 5% of America’s gross domestic product, or total economic output.

Defense spending when measured as a portion of GDP is currently about 3% and has been declining since the height of the wars in Afghanistan and Iraq. It has not reached above 5% since the early 1990s.

Back in the 1980s and early 1990s, Wicker said, “nobody took a chance against the United States because we were powerful enough to keep the peace. We are simply not anywhere near that right now.”

“I think that the fact that we’re in a new Cold War is self-evident,” he said.

Wicker’s full plan is laid out in a 52-page paper he has been working on for the past year. In it, he makes the case for a new generation of weapons, pointing to an aging American arsenal as Russia moves to expand its territory in Europe and China tries to show increasing dominance in parts of the Pacific.

Closer ties between China and Russia were underscored earlier this month by a visit between leaders Vladimir Putin and Xi Jinping. The two-day visit — Putin’s first trip abroad after being inaugurated to a fifth term in office — reflected a growing partnership between the two nations, an alliance grounded in support for authoritarian regimes and dominance in their respective regions.

China has given diplomatic support to Moscow after its invasion of Ukraine and emerged as a top export market for Russian oil and gas, helping fill the Kremlin’s war coffers for the ongoing offensive.

Wicker said the high-level meeting between Putin and Xi “ought to be a wake up call.”

He said in his proposal that the U.S. faces “the most dangerous threat environment since World War II” and urges a national war footing appropriate for a long, drawn-out conflict with a major world power. For Wicker, that encompasses everything from addressing deferred maintenance on U.S. military facilities that don’t have the right voltage on power outlets to preparing for nuclear weaponry in space.

Still, the spending increases are likely to be viewed skeptically by lawmakers wary of growing the defense budget, which already dominates annual discretionary funding. The legislation to suspend the nation’s debt limit passed Congress with strong bipartisan support and aimed to limit federal budget growth to 1% for the next six years, although the spending caps were only mandatory through this year’s budget.

The House Armed Services Committee this month approved with near-unanimous support an $884 billion proposal for the annual defense authorization bill, keeping within the spending caps but shifting funding towards specific military programs. Yet Senate Democrats are likely to resist further spending cuts to other government programs.

The Senate committee is set to craft the annual military authorization bill next month, but the chairman, Democratic Sen. Jack Reed of Rhode Island, has not publicly released the spending amount that he will propose. Wicker said that he had been in contact with Reed, as well as top Democratic appropriators, about the plan, but their level of support was not clear.

At the same time, defense hawks like Wicker are navigating the shifting politics of defense spending in their own party under Trump’s “America First” brand of foreign policy. Earlier this year, a $95 billion package of foreign aid for Ukraine, Israel and Taiwan faced heavy resistance from a large portion of congressional Republicans, even though much of the funds would be spent buying equipment and ammunition from U.S.-based defense manufacturers.

Senate Republican leader Mitch McConnell, R-Ky., has been vocal about countering those within his party who want to push the U.S. towards a more isolationist stance. And Wicker said there was “an opportunity” to win broad support for redoubling U.S. efforts in the Pacific because congressional Republicans are still supportive of countering China.

As he works to convince Congress to rethink defense spending, Wicker said he was modeling his effort on the push that former Sen. John McCain, an Arizona Republican, made in 2017 as he tried to dramatically increase defense spending. That effort was mostly unsuccessful.

But Wicker expressed confidence that this time can be different.

With China’s military strength dramatically growing and Russia launching the largest land invasion in Europe since World War II, the difference between 2017 and now is “the reality on the ground,” he said.

WASHINGTON (AP) — Defense Secretary Lloyd Austin underwent a medical procedure at Walter Reed National Military Medical Center Friday evening and has resumed duty after temporarily transferring power to his deputy, Pentagon press secretary Maj. Gen. Pat Ryder said in a statement.

Austin is continuing to deal with bladder issues that arose in December following his treatment for prostate cancer, Ryder said.

The procedure was successful, elective and minimally invasive, “is not related to his cancer diagnosis and has had no effect on his excellent cancer prognosis,” the press secretary said.

Austin transferred authority to Deputy Secretary of Defense Kathleen Hicks for about two-and-a-half hours while he was indisposed, the Pentagon said.

The Pentagon chief returned home after the procedure. “No changes in his official schedule are anticipated at this time, to include his participation in scheduled Memorial Day events,” Ryder said.

Austin, 70, has had ongoing health issues since undergoing surgery to address a prostate cancer diagnosis. He spent two weeks in the hospital following complications from a prostatectomy. Austin faced criticism at the time for not immediately informing the president or Congress of either his diagnosis or hospitalization.

Austin was taken back to Walter Reed in February for a bladder issue, admitted to intensive care for a second time and underwent a non-surgical procedure under general anesthesia at the time.

WASHINGTON (AP) — Cyberattacks against water utilities across the country are becoming more frequent and more severe, the Environmental Protection Agency warned Monday as it issued an enforcement alert urging water systems to take immediate actions to protect the nation’s drinking water.

About 70% of utilities inspected by federal officials over the last year violated standards meant to prevent breaches or other intrusions, the agency said. Officials urged even small water systems to improve protections against hacks. Recent cyberattacks by groups affiliated with Russia and Iran have targeted smaller communities.

Some water systems are falling short in basic ways, the alert said, including failure to change default passwords or cut off system access to former employees. Because water utilities often rely on computer software to operate treatment plants and distribution systems, protecting information technology and process controls is crucial, the EPA said. Possible impacts of cyberattacks include interruptions to water treatment and storage; damage to pumps and valves; and alteration of chemical levels to hazardous amounts, the agency said.

“In many cases, systems are not doing what they are supposed to be doing, which is to have completed a risk assessment of their vulnerabilities that includes cybersecurity and to make sure that plan is available and informing the way they do business,” said EPA Deputy Administrator Janet McCabe.

Attempts by private groups or individuals to get into a water provider’s network and take down or deface websites aren’t new. More recently, however, attackers haven’t just gone after websites, they’ve targeted utilities’ operations instead.

Recent attacks are not just by private entities. Some recent hacks of water utilities are linked to geopolitical rivals, and could lead to the disruption of the supply of safe water to homes and businesses.

McCabe named China, Russia and Iran as the countries that are “actively seeking the capability to disable U.S. critical infrastructure, including water and wastewater.”

Late last year, an Iranian-linked group called “Cyber Av3ngers” targeted multiple organizations including a small Pennsylvania town’s water provider, forcing it to switch from a remote pump to manual operations. They were going after an Israeli-made device used by the utility in the wake of Israel’s war against Hamas.

Earlier this year, a Russian-linked “hacktivist” tried to disrupt operations at several Texas utilities.

A cyber group linked to China and known as Volt Typhoon has compromised information technology of multiple critical infrastructure systems, including drinking water, in the United States and its territories, U.S. officials said. Cybersecurity experts believe the China-aligned group is positioning itself for potential cyberattacks in the event of armed conflict or rising geopolitical tensions.

“By working behind the scenes with these hacktivist groups, now these (nation states) have plausible deniability and they can let these groups carry out destructive attacks. And that to me is a game-changer,” said Dawn Cappelli, a cybersecurity expert with the industrial cybersecurity firm Dragos Inc.

The world’s cyberpowers are believed to have been infiltrating rivals’ critical infrastructure for years planting malware that could be triggered to disrupt basic services.

The enforcement alert is meant to emphasize the seriousness of cyberthreats and inform utilities the EPA will continue its inspections and pursue civil or criminal penalties if they find serious problems.

“We want to make sure that we get the word out to people that ‘Hey, we are finding a lot of problems here,’” McCabe said.

EPA did not say how many cyber incidents have occurred in recent years, and the number of attacks known to be successful so far is few. The agency has issued nearly 100 enforcement actions since 2020 regarding risk assessments and emergency response, but said that’s a small snapshot of the threats water systems face.

Preventing attacks against water providers is part of the Biden administration’s broader effort to combat threats against critical infrastructure. In February, President Joe Biden signed an executive order to protect U.S. ports. Health care systems have been attacked. The White House has pushed electric utilities to increase their defenses, too. EPA Administrator Michael Regan and White House National Security Advisor Jake Sullivan have asked states to come up with a plan to combat cyberattacks on drinking water systems.

“Drinking water and wastewater systems are an attractive target for cyberattacks because they are a lifeline critical infrastructure sector but often lack the resources and technical capacity to adopt rigorous cybersecurity practices,” Regan and Sullivan wrote in a March 18 letter to all 50 U.S. governors.

Some of the fixes are straightforward, McCabe said. Water providers, for example, shouldn’t use default passwords. They need to develop a risk assessment plan that addresses cybersecurity and set up backup systems. The EPA says they will train water utilities that need help for free. Larger utilities usually have more resources and the expertise to defend against attacks.

“In an ideal world … we would like everybody to have a baseline level of cybersecurity and be able to confirm that they have that,” said Alan Roberson, executive director of the Association of State Drinking Water Administrators. “But that’s a long ways away.”

Some barriers are foundational. The water sector is highly fragmented. There are roughly 50,000 community water providers, most of which serve small towns. Modest staffing and anemic budgets in many places make it hard enough to maintain the basics — providing clean water and keeping up with the latest regulations.

“Certainly, cybersecurity is part of that, but that’s never been their primary expertise. So, now you’re asking a water utility to develop this whole new sort of department” to handle cyberthreats, said Amy Hardberger, a water expert at Texas Tech University.

The EPA has faced setbacks. States periodically review the performance of water providers. In March 2023, the EPA instructed states to add cybersecurity evaluations to those reviews. If they found problems, the state was supposed to force improvements.

But Missouri, Arkansas and Iowa, joined by the American Water Works Association and another water industry group, challenged the instructions in court on the grounds that EPA didn’t have the authority under the Safe Drinking Water Act. After a court setback, the EPA withdrew its requirements but urged states to take voluntary actions anyway.

The Safe Drinking Water Act requires certain water providers to develop plans for some threats and certify they’ve done so. But its power is limited.

“There’s just no authority for (cybersecurity) in the law,” Roberson said.

Kevin Morley, manager of federal relations with the American Water Works Association, said some water utilities have components that are connected to the internet — a common, but significant vulnerability. Overhauling those systems can be a significant and costly job. And without substantial federal funding, water systems struggle to find resources.

The industry group has published guidance for utilities and advocates for establishing a new organization of cybersecurity and water experts that would develop new policies and enforce them, in partnership with the EPA.

“Let’s bring everybody along in a reasonable manner,” Morley said, adding that small and large utilities have different needs and resources.

WASHINGTON (AP) — Federal Deposit Insurance Corp. Chairman Martin Gruenberg sat for a second day of grilling Thursday on Capitol Hill, this time at the Senate Banking Committee, after a damning report about the agency’s toxic workplace culture was released last week.

The hearing was called to address oversight of financial regulators, including the Office of the Comptroller and the Federal Reserve, but two days of testimony have largely focused on the workplace culture at the FDIC and failures, according to the report, by Gruenberg to prevent hundreds of instances of harassment and discrimination against employees.

An independent review of the FDIC ‘s workplace culture released last week describes an environment that fostered “hostile, abusive, unprofessional, or inappropriate conduct,” and questions whether the agency’s chairman is able to lead the agency through a cultural transformation.

The report released Tuesday by law firm Cleary Gottlieb Steen & Hamilton cites incidents of stalking, harassment, homophobia and other violations of employment regulations, based on more than 500 complaints from employees.

Complaints included a woman who said she was stalked by a coworker and continually harassed even after complaining about his behavior; a field office supervisor referring to gay men as “little girls”; and a female field examiner who described receiving a picture of an FDIC senior examiner’s private parts.

The FDIC is one of several banking system regulators. The Great Depression-era agency is best known for running the nation’s deposit insurance program, which insures Americans’ deposits up to $250,000 in case their bank fails.

On Thursday, Republican lawmakers roundly called on Gruenberg, who is a Democrat, to resign, after a similar grilling at the House Financial Services Committee on Wednesday. At Thursday’s hearing, Sen. Tim Scott (R-SC) detailed several stories of female FDIC workers who outlined extreme harassment and stalking by their coworkers, complaints that were dismissed by supervisors, according to the report.

“Marty — you’ve heard me say this to you directly — you should resign,” Scott said. “Your employees do not have confidence in you. And this is not a single incident. This spans over a decade-plus of your leadership at the FDIC.”

Gruenberg said in his testimony that he takes “full responsibility to anyone who has experienced sexual harassment, discrimination or other misconduct at the FDIC. I again want to apologize and express how deeply sorry I am.”

Democratic Senators did not call on the agency chairman to resign, but called on Gruenberg to change the agency.

“Chair Gruenberg, it’s up to you to prove to the public and to your employees that you are that leader, and are able to restore confidence in the FDIC,” Committee Chair Sen. Sherrod Brown (D-OH) said.

Sen. John Kennedy said he plans to introduce a bill that will extend the statute of limitations for FDIC employees to file suit over the abuses they experienced while employed at the agency.

“Have you ever heard the expression ‘a fish rots from the head down?’” Kennedy (R-LA) asked Gruenberg, adding, “you’re not going to be able to clean up the FDIC because you’re going to be too busy defending yourself in court.”

Gruenberg heard similar comments to either step down or make serious reforms from Democrats and Republicans on Wednesday, when he appeared in front of the House Financial Services Committee.

“There is a deficit of trust and your credibility has been undermined,” said Rep. Ayanna Pressley, D-Massachusetts, at Wednesday’s hearing.

WASHINGTON (AP) — The Supreme Court on Thursday rejected a conservative-led attack that could have undermined the Consumer Financial Protection Bureau.

The justices ruled 7-2 that the way the CFPB is funded does not violate the Constitution, reversing a lower court and drawing praises from consumers. Justice Clarence Thomas wrote the majority opinion, splitting with his frequent allies, Justices Samuel Alito and Neil Gorsuch, who dissented.

The CFPB was created after the 2008 financial crisis to regulate mortgages, car loans and other consumer finance. The case was brought by payday lenders who object to a bureau rule that limits their ability to withdraw funds directly from borrowers’ bank accounts. It’s among several major challenges to federal regulatory agencies on the docket this term for a court that has for more than a decade been open to limits on their operations.

The CFPB, the brainchild of Democratic Sen. Elizabeth Warren of Massachusetts, has long been opposed by Republicans and their financial backers. The bureau says it has returned $19 billion to consumers since its creation.

Outside the Supreme Court following the decision, Warren said, “The Supreme Court followed the law, and the CFPB is here to stay.”

President Joe Biden, a fellow Democrat who has taken steps to strengthen the bureau, called the ruling “an unmistakable win for American consumers.”

Unlike most federal agencies, the consumer bureau does not rely on the annual budget process in Congress. Instead, it is funded directly by the Federal Reserve, with a current annual limit of around $600 million.

The federal appeals court in New Orleans, in a novel ruling, held that the funding violated the Constitution’s appropriations clause because it improperly shields the CFPB from congressional supervision.

Thomas reached back to the earliest days of the Constitution in his majority opinion to note that “the Bureau’s funding mechanism fits comfortably with the First Congress’ appropriations practice.”

In dissent, Alito wrote, “The Court upholds a novel statutory scheme under which the powerful Consumer Financial Protection Bureau (CFPB) may bankroll its own agenda without any congressional control or oversight.”

The CFPB case was argued more than seven months ago, during the first week of the court’s term. Lopsided decisions like Thursday’s 7-2 vote typically don’t take so long, but Alito’s dissent was longer than the majority opinion, and two other justices, Elena Kagan and Ketanji Brown Jackson, wrote separate opinions even though they both were part of the majority.

Consumer groups cheered the decision, as did a bureau spokesman.

“For years, lawbreaking companies and Wall Street lobbyists have been scheming to defund essential consumer protection enforcement,” bureau spokesman Sam Gilford said in a statement. “The Supreme Court has rejected their radical theory that would have devastated the American financial markets. The Court repudiated the arguments of the payday loan lobby and made it clear that the CFPB is here to stay.”

Jesse Van Tol, president and CEO of the National Community Reinvestment Coalition, said the decision upholding the consumer bureau’s funding structure would have positive effects across the U.S. economy.

“It’s always nice to see the courts get something right — especially in this tawdry circumstance where payday loan predators sought to wriggle out of basic oversight using absurd distortions of law and fact,” Van Tol said in a statement.

While the U.S. Chamber of Commerce and some other business interests backed the payday lenders, mortgage bankers and other sectors regulated by the CFPB cautioned the court to avoid a broad ruling that could unsettle the markets.

In 2020, the court decided another CFPB case, ruling that Congress had improperly insulated the head of the bureau from removal. The justices said the director could be replaced by the president at will but allowed the bureau to continue to operate.

NEW YORK (AP) — Federal grants can be a huge boost for small businesses. And some federal agencies do better at giving grants to small businesses than others.

The Small Business Administration released its annual scorecard measuring how well federal agencies meet their small business contracting goals each year.

Overall, the federal government has a goal to award 23% of contracts to small businesses. In fiscal 2023, 28.4% of contracts were awarded to small businesses, amounting to $178.6 billion. It’s the third year of exceeding the goal, according to the SBA.

The SBA said the contracts support over a million jobs in industries like manufacturing, construction, and technology.

“Through President Biden’s Investing in America agenda, we have championed initiatives to fuel the nation’s economy – ensuring competition and a level playing field so that small businesses can access the historic level of investments through federal contracting,” said SBA Administrator Isabel Casillas Guzman.

Ten federal agencies received ‘A+’ grades on the annual scorecard. Those included: the SBA, Department of Agriculture, Department of Housing and Urban Development, Department of the Interior, Department of Homeland Security, National Science Foundation, General Services Administration, Department of Commerce, Nuclear Regulatory Commission, and Office of Personnel Management.

Two agencies that received a ‘B,’ the lowest grade awarded: the Environmental Protection Agency and the Department of Health and Human Services.

WASHINGTON (AP) — President Joe Biden on Monday issued an order blocking a Chinese-backed cryptocurrency mining firm from owning land near a Wyoming nuclear missile base, calling its proximity to the base a “national security risk.”

The order forces the divestment of property operated as a crypto mining facility near the Francis E. Warren Air Force Base. MineOne Partners Ltd., a firm partly backed by Chinese nationals, and its affiliates are also required to remove certain equipment on the site.

This comes as the U.S. is slated on Tuesday to issue major new tariffs on electric vehicles, semiconductors, solar equipment and medical supplies imported from China, according to a U.S. official and another person familiar with the plan.

And with election season in full swing, both Biden and his presumptive Republican challenger, former President Donald Trump, have told voters that they’ll be tough on China, the world’s second-largest economy after the United States and an emerging geopolitical rival.

The Monday divestment order was made in coordination with the U.S. Committee on Foreign Investment in the United States — a little-known but powerful government committee tasked with investigating corporate deals for national security concerns that holds power to force companies to change ownership structures or divest completely from the U.S.

A 2018 law granted CFIUS the authority to review real estate transactions near sensitive sites across the U.S., including F.E. Warren Air Force Base.

MineOne purchased the land that is within one mile of the Air Force base in Cheyenne in 2022, and according to CFIUS, the purchase was not reported to the committee as required until after the panel received a public tip.

The order was vague about the specific national security concerns, with the Treasury Department saying only that there were issues with “specialized and foreign-sourced equipment potentially capable of facilitating surveillance and espionage activities” that “presented a significant national security risk.”

A representative from the firm did not respond to an Associated Press request for comment.

Treasury Secretary Janet Yellen, who serves as the chairperson of CFIUS, said the role of the committee is “to ensure that foreign investment does not undermine our national security, particularly as it relates to transactions that present risk to sensitive U.S. military installations as well as those involving specialized equipment and technologies.”

The committee is made up of members from the State, Justice, Energy and Commerce Departments among others, which investigates national security risks from foreign investments in American firms.

CFIUS directed the sale of the property within 120 days, and that within 90 days the company remove all structures and equipment on the site.

HONOLULU (AP) — The U.S. government said Monday it took responsibility for jet fuel that leaked into a Navy water system serving 93,000 people in 2021, but attorneys dispute whether the families who are suing were exposed to enough tainted water to make them sick.

A trial for a mass environmental injury case began in federal court in Honolulu on Monday, more than two years after a U.S. military fuel tank facility under ground poisoned thousands of people when it leaked jet fuel into Pearl Harbor’s drinking water.

Instead of a jury, a judge is hearing about a lawsuit against the United States by 17 “bellwether” plaintiffs: a cross-selection of relatives of military members representing more than 7,500 others, including service members, in three federal lawsuits.

According to court documents, the U.S. government has admitted the Nov. 20, 2021, spill at the Red Hill Bulk Fuel Storage Facility caused a nuisance for the plaintiffs, that the United States “breached its duty of care” and that the plaintiffs suffered compensable injuries.

But they dispute whether the residents were exposed to jet fuel at levels high enough to cause their alleged health effects, ranging from vomiting to rashes.

The plaintiffs have submitted declarations describing how the water crisis sickened them and left them with ongoing health problems, including seizures, asthma, eczema and vestibular dysfunction.

The Navy mobilized after getting reports about the water, Rosemary Yogiaveetil, an attorney with the U.S. Department of Justice, said in an opening statement in court. Crews went to homes and began taking water samples and officials shut down the Red Hill well as a precaution, she said.

They began “flushing each and every home on the water line,” to restore clean water, Yogiaveetil said. The Navy began providing bottled water and paid for months of hotel rooms for some affected families.

Lawyers for the plaintiffs argue Navy officials knew there was fuel in the water and failed to warn people not to drink it, even while telling residents the water was safe.

The families lost trust in the institutions they themselves served, Kristina Baehr, one of the attorneys for the plaintiffs, said in an opening statement.

“Home was supposed to be a place they felt safe,” especially during the pandemic, she said.

Nastasia Freeman, wife of a Navy officer and mother of three, described in her declaration how the family thought their vomiting and diarrhea was Thanksgiving food poisoning.

“I had developed a rash on my arms with sores and lesions on my scalp, feet, and hands accompanied by a headache,” she wrote. “I had a very strange sensation that I had never had before — I felt like my blood was on fire.”

Even their dogs were vomiting.

On Nov. 29, a nurse told her she received multiple calls all with a common theme: the tap water.

“It felt like we were being gaslit,” Freeman’s declaration said. “We knew the water wasn’t safe, but the Navy was telling us that it was. They said they didn’t know what was in the water and that they were ‘investigating.’”

She was expected to be the first of the plaintiffs to be cross-examined in court Monday.

Experts will testify during the trial that the “myriad of injuries” the plaintiffs claim were preexisting conditions or had no known link to the fuel exposure, Yogiaveetil said.

A Navy investigation report in 2022 listed a cascading series of mistakes from May 6, 2021, when an operator error caused a pipe to rupture and caused 21,000 gallons (80,000 liters) of fuel to spill while it was transferred between tanks. Most of this fuel spilled into a fire suppression line and sat there for six months, causing the line to sag. When a cart rammed into this sagging line on Nov. 20, it released 20,000 gallons (75,700 liters) of fuel.

When people started speaking up about the water, the Navy understood there had been a leak on Nov. 20, but at the time, they believed it was contained, Yogiaveetil said Monday.

The military eventually agreed to drain the tanks, amid state orders and protests from Native Hawaiians and other Hawaii residents concerned about the threat posed to Honolulu’s water supply. The tanks sit above an aquifer supplying water to 400,000 people in urban Honolulu.

Outside the courthouse Monday, activists calling themselves water protectors held signs in support of the plaintiffs.

A lot is riding on this trial.

“A bellwether trial helps attorneys to understand the likely success or failure of the cases that are in the pipeline,” explained Loretta Sheehan, a Honolulu-based personal injury attorney not involved in the water litigation.

The outcome can help determine future damages to be awarded or settlements, she said.

  • The Justice Department's effort to crack down on pandemic fraud has recovered more than $3 billion since 2021. In a new report, the COVID-19 Fraud Enforcement Task Force said that it has filed criminal charges against more than 3,500 people and won more than 400 civil settlements and judgments worth over $100 million. The task force has also won pandemic fraud criminal cases against more than 2,000 people. Over the last year, DoJ added more resources in each state by naming assistant attorneys general focused on pandemic fraud enforcement. Additionally, DoJ established five COVID-19 Fraud Enforcement Strike Forces across six federal districts to pursue the most impactful criminal fraud cases.
  • Another federal cyber executive is heading out the door. Sean Connelly, who has led many of the major federal cybersecurity initiatives over the last decade, is departing government for the private sector. The TIC program manager and senior cyber architect at CISA will join Zscaler. He will lead their international zero trust compliance efforts. Connelly is leaving federal service after 11 years at CISA and seven plus years as a contractor, working for the State Department and NOAA. Federal News Network has learned Connelly’s last day will be April 19. During his time at CISA, Connelly has been the face and brains behind the TIC and zero trust programs.
  • A one-stop shop for Americans to access government benefits and services is about to test out facial recognition. The General Services Administration (GSA) is launching a pilot program in May that will allow individuals to sign into Login.gov with a “selfie.” Facial recognition tools will match the photo to a form of government ID, like a driver’s license, to verify a user’s identity. GSA said this will help people sign up for federal services easily, while protecting them from identity theft and cyberattacks. The agency claims these facial recognition tools will meet federal identity proofing standards. That’s after a federal watchdog found GSA misled agency customers for years about meeting those standards.
  • A Pathways Program overhaul is aiming to open the doors to more job candidates. Skills-based hiring and reduced requirements will now be major priorities for agencies who use the Pathways Program. The Office of Personnel Management has issued a final rule to update the program, focused on bringing in more early-career federal talent. Under the changes, federal interns will see lower requirements for converting into full-time federal jobs. And graduates of programs like the Peace Corps or Registered Apprenticeships can also now apply to Pathways, regardless of whether they have a college degree. The Biden administration is hoping the changes will bring in more diverse federal employees and ease hiring burdens on agencies.
  • While the details to the Navy's Project Overmatch are veiled in secrecy, officials said project delivery continues to be ahead of schedule. Project Overmatch already provides software capabilities to at least three carrier strike groups and numbered fleets. Rear Adm. Doug Small said the service is laser-focused on fielding software rather than buying new hardware. Project Overmatch is the Navy’s contribution to the Pentagon’s CJADC2 effort to connect all networks.
  • Employees at the Defense Health Agency now have a solid outline of their union rights and other workforce protocols. A new labor-management agreement with the American Federation of Government Employees (AFGE) details, among other things, the agency's policies on work hours, leave, official time, and telework. The interim agreement is effective immediately for DHA's 38,000 bargaining unit employees, who first voted to unionize in 2022. In the meantime, AFGE said it will be training local union officials to make sure the agreement is carried out in practice.
  • Junior enlisted service members could get a 15% hike to their base pay as soon as next year. The plan is part of a comprehensive military quality-of-life report unveiled by lawmakers on Thursday. While service members receive pay increases every year, they are not keeping up with inflation. The proposed pay raise would bring the salaries of junior enlisted service members to over $30,000 annually. Lawmakers vowed the report’s recommendation will be in the 2025 National Defense Authorization Act.
  • A Senate committee is trying to find out why the Postal Service keeps raising its mail prices. The Senate Homeland Security and Governmental Affairs Committee will hold a hearing on Tuesday. It will hear from Postmaster General Louis DeJoy, as well as a postal regulator that has been approving these higher mail prices. The USPS inspector general and the chairman of the USPS Board of Governors are also slated to testify. USPS plans to raise the price of a first-class stamp to 73 cents in July. That is its sixth price increase since 2020.

To learn more about what that research found, I got the chance to speak with Bruce McClintock, Senior Policy Researcher and lead of RAND's Space Enterprise Initiative.nn<em><strong>Interview Transcript:\u00a0<\/strong><\/em>n<blockquote><strong>Bruce McClintock <\/strong>So in about the 2022-time frame. Lieutenant General Whiting and he was at the time was in Space Operations Command commander, a Beatles commander in United States Space Force, asked Rand to take a close look at how the US was currently cooperating with select allies on space operations matters and where they're all ..... those relationships. So that was very active in the project in that time.nn<strong>Eric White <\/strong>All right. And so, in looking through that, you know, what entities did you speak with, and how did you go about trying to find out those answers for them?nn<strong>Bruce McClintock <\/strong>So we used a very rigorous approach where the project started off by. Well, throughout the course of the project, we conducted over 140 interviews with more than 115 people that represented 24 different organizations. And those organizations included representatives from select allied countries, NATO Space Center, ..., Space Command headquarters, EUCOM headquarters, several Department of Air Force organizations all the way up to senior policy level. And then below, on top of those interviews, we actually conducted 13 different site visits, to include visits to the United Kingdom, Germany, France, Canada, and then several U.S. military networks. In conjunction with all that, we then analyzed close to 200 different documents, ranging from U.S. policy documents to plans for space operations to country specific documents. So, it's a pretty rigorous, very holistic approach to conducting the research for the project.nn<strong>Eric White <\/strong>All right. And so, then the next question is what some of your findings were. So, let's go through it. You did a lot of site visits. You talked to a lot of allies. When it comes to space and U.S. space policy, you know, what were some of the concerns that that you were hearing from counterparts in other governments?nn<strong>Bruce McClintock <\/strong>So one of the most common things that we heard from counterparts in other governments are what they often euphemistically referred to as the gap, or the policy or practice gap, if you will. And what they mean by that is that the U.S. was often cited as being very much publicly committed to integrating allies in the space activities and operations. But at the end of the day, in many cases didn't deliver at the level where it was stated publicly.nn<strong>Eric White <\/strong>Were there any, you know, examples of this that you can give me that were brought up? And, you know, I don't need you to go through the litany of, of any policy failures, but just an example of what they meant by that.nn<strong>Bruce McClintock <\/strong>Sure. So, you know, one of the most frequent, especially in interviews with specific allies, one of the most frequent examples that we would encounter once the failure of the US in many cases to fully include exchange officers from other countries in space related discussions or activities. And I think it's an important distinction here. In the U.S. parlance, there are two types of foreign officers involved in activities. There are liaison officers, which are officers that represent the interests of their country, but their liaison with the United States. So, it'll be a representative of their foreign country that might be assigned to the US or another nation as a liaison. On the other hand, there are exchange officers which are intended to be a foreign national that are embedded in the US positions of filling US roles and responsibilities. And often what we heard was that means these allies will put into exchange ops or billets. And were told they were going to be doing a specific job in support of US national interests. Often weren't given access to information that was necessary to perform the job that they were posted to. But that's just one example. There were many others, but that's not that was a very common.nn<strong>Eric White <\/strong>Yeah. This comes down to you know, disclosure policies. I mean, the U.S. works in many arenas with its allies, whether it be, you know, on the waters or even in ground operations or anything like that. My question is, why is space such a vexing problem for when it comes to what information we can disclose to our allies and what we can't? What exactly are the hurdles? Or, you know, is it just, you know, bureaucratic? Oh. I'm sorry. You know, you should have access to this, but you for some reason, don't.nn<strong>Bruce McClintock <\/strong>So I think it's a combination of at the highest level and it\u2019s just an evolution, based on information sharing between two different major departments in the U.S.. So that's Department of Defense and intelligence community. At that very high level, even though their guidance flowed originally from the same executive order, they've both taken different approaches to that kind of process for information sharing. And then it does flow down because of that high level disconnect between those two organizations. It does flow down to lower levels, where there are essentially bureaucratic impediments that could be overcome, but there's not necessarily motivation to overcome those impediments that exist.nn<strong>Eric White <\/strong>Yeah. And what were some of the solutions that you all garnered? And then we can also get into some of the other, other aspects of this report. But as far as that solutions go. What is the idea there of, you know, making sure that everybody is at least on the same page when it comes to information sharing?nn<strong>Bruce McClintock <\/strong>So one of the one of the very high-level things we recommended was that we thought there should be a deputy secretary defense level coordination effort with the ODNI. Obviously, director of National intelligence that really spanned that divide between DoD policies. And what is generally referred to as the ICC, the intelligence community policy on information sharing. And that that would be a very high-level effort, a working group if you will, that we thought would take a couple of years, but we thought we could be that high level because there are still disagreements within DoD components and uncertainty about their own internal DoD roles and responsibilities. So, because of those two aspects, we recommended a very high-level working group billet.nn<strong>Eric White <\/strong>We're talking here with, Bruce McClintock. He's a senior policy researcher at the Rand Corporation and also the lead of the Rand Corporation Space Enterprise Initiative. So, let's get a little bit more holistic here. What is the optimal amount of coordination that needs to happen between the U.S. government and its allies when it comes to space? What would be the ideal situation there?nn<strong>Bruce McClintock <\/strong>I'd say before we get into the actual optimal level of involvement, I think the first step to the United States is just come up with a coherent holistic policy on involving our allies, and that doesn't exist right now. That contributes somewhat to the capacity do gap problem. Some of the outstanding options, and one of the things that we would say more about holistic approach is it's not every ally is going to be treated the same way. Right. So, this isn't about opening the floodgates that we will and sharing everything with every ally. There needs to be a thoughtful approach to how much we're going to share with people allies. But the US need to be clear upfront about mutual relationship levels so that that's point one. I would note on that. Once you have decided on those different levels. And by the way, this is what this is a relationship that goes two ways. There are different allies that want different levels of interaction with the United States. Not every ally wants to be fully integrated with beyond states in terms of space operation. And that's, of course, their national sovereign right. So, both sides need to be clear with each other. Once you establish those different relationship level expectations by ally, then you set up a U.S. structure that addresses those different levels. And the U.S. has made some progress in this area. Some of that starts with just basic information exchange and information sharing at the fully unclassified level. So, this is not always about having a very highly qualified conversation. That makes sense.nn<strong>Eric White <\/strong>Yeah it does. And you know, not to be you know, two to our own horn or anything. We've got a pretty good space program especially you know; we've got the Space Force that now is doing its own thing. What exactly does the U.S. need or rely on its allies? You know, the major allies out there? You know, since their space programs may not be as advanced, what exactly are is the U.S. getting from these, allies in the space arena?nn<strong>Bruce McClintock <\/strong>Two broad terms to describe what the advantages to working with allies, because the US don't have a very robust, very strong space program when you speak about national security in general. But the first thing I would talk about is coverage of sector one, diversity. And there are other aspects that we could talk about later in life. So, the coverage thing, I think, is the one that is arguably the most important commercial quality, because space is not just about putting things on orbit, it's also about being able to detect, characterize and track things that are on it. And that requires geographic locations across the globe. Right. So, we've been doing a little use of the parameter space power. Now we need geographic access to other territories to be able to improve our space situational awareness network and also our space domain awareness infrastructure. And the same is true for potential future adversaries like China. Like, so we're out pursuing locations to be in the satellite tracking territory and not China. So that's one very obvious example. It's the information sharing like space situational awareness, which is the most fully developed program in the U.S.\u00a0 The U.S. has a large number of agreements signed with other nations and other entities or SSA Galaxy. So that goes to the coverage piece. But there's also value in diversity and space capabilities. Things like things that are on orbit but also ground stations become more vulnerable to threats. It's good to have a diverse set of resources available.nn<strong>Eric White <\/strong>Are there other areas. And you talked a little bit about it as far as intelligence sharing and coordinating with ODNI, are there other areas where the U.S. government works with its allies, you know, in other arenas that these space policy folks can draw from and see? Okay, so that's how they do it. You know, maybe we can apply that idea when it comes to, coordination on the space end when you're up, up higher a little bit.nn<strong>Bruce McClintock <\/strong>So for our research, we took a pretty close look at a couple of other domains to draw lessons in best practices from those other domains. And the first area that we looked at in particular was nuclear weapons cooperation. For a couple of reasons. We thought that would be an interesting case. First of all, nuclear weapons will probably be most carefully guarded about capabilities, most sensitive, even more so than space capabilities. And so, we wanted to see if there was even any potential share at that level. And there was, in the mid-1950s, we had the United States had exceptional capabilities in that domain, but the Soviet Union was a threat to us. And so, the United States worked closely with the United Kingdom to come up with, neutral .... That were related to nuclear weapons. There was some level of data sharing between the United States and United Kingdom. And there was other, information exchange and coordination that, was important if you consider to be best practices. We also looked at, special operations, any newer area where there has been much touting about being able to cooperate with allies and share information in a way that hasn't been demonstrated yet in inspection of it. So those are two areas that we looked at. Looked at the two others, two clearly are in charge and sharing opinions, see, and the three primary areas limiting jamming.nn<strong>Eric White <\/strong>All right. And so yeah, there's really nothing more that you can say about what's at stake when you talk about nuclear weapons, but what's at stake when it comes to space. And, you know, if we don't get this right as far as working and we're getting the most that we can out of these relationships with our allies in that domain.nn<strong>Bruce McClintock <\/strong>I think it, I'll start at the lowest level of what's at stake. It's just a reduction in efficiency. And by that, I mean, in some cases, if allies feel like they can't depend on the US to share important national security related information about space, then these allies that have significantly more limited resources than the United States has, they feel obligated to invest in their own capabilities for things as simple as space situational awareness, which I talked about earlier, whereas we had a much more robust information sharing, relationship where it was maybe not fully reciprocal, but it share the pieces of information that they could invest, that those resources in other aspects of space security that could be to the benefit of the U.S. So that's one example. It's reduced efficiency if we just don't cooperate as well with our closest allies. If you move up the scale in terms of the significance of the impact, the adverse impact. If we don't, find ways to become allied by design. There are things like reduced trust and willingness to depend on the United States in times of crisis when it comes to space. So those are now obviously more extreme, but they are package, and I don't feel like they could count on the United States to share information when the quote unquote chips are down. Then they sometimes say, well, we need to figure out ways to be not only independent but have our own capability. And then there's less of a need for them to turn to the US on geopolitical policy decisions.nn<strong>Eric White <\/strong>Wrapping up here, I'll give you a chance to say anything else on this topic that you think is important for the conversation. But if you could run through also just, you know, some of the other recommendations that you all made, based on what you found in, you know, talking and also what did DoD have to say about this? I guess we could actually ask them and include them in this.nn<strong>Bruce McClintock <\/strong>Yeah. So I would say as far as what the DoD has to say about this, first of all, you know, I applaud the Department of Defense, starting with, Gerald Whiting for taking an interest in this topic and asking somebody like Rand to look at it because they knew that they were going to get an independent, objective and rigorous analysis of the problem. That we weren't going to just tell them what they wanted to hear. So not only by initiating process, but then listening to throughout the course of the last couple of years and they provided preliminary insights and recommendations on our final findings and recommendations. I want to applaud, you know, the Department of Defense for being so willing to listen, because it's not always easy to listen to something that might be tough love. They're not telling you exactly what you want to hear. And in that vein, I think over the last couple of years, the Department of Defense has taken on some of the recommendation, not all of them by any means, but that's their prerogative. But they have done things like made expanded the interaction with allies in select venues. So, they have grown and see SPO initiatives that combined space operations in which, you know, that used to be seven nations, it now 10. They're working on our international space cooperation strategy that was informed by this Rand research. And it'll also want to applaud a recent announcement from OSD, where they signed a memo that removes a lot of the legacy classification barriers that have inhibited the United States' ability to collaborate across the U.S. and with allies. Now, that's a direct example of a recommendation we made, not necessarily because of the Rand report, but in line with the Rand report's findings and recommendations that the department backs. So, there been great steps taken. There's a lot more to be done.nn<strong>Eric White <\/strong>Bruce McClintock is senior policy researcher and lead of the Space Enterprise Initiative at the Rand Corporation. At that very high level, even though their guidance flowed originally from the same executive order, they’ve both taken different approaches to that kind of process for information sharing. And then it does flow down because of that high level disconnect between those two organizations. It does flow down to lower levels, where there are essentially bureaucratic impediments that could be overcome, but there’s not necessarily motivation to overcome those impediments that exist.

Eric White Yeah. And what were some of the solutions that you all garnered? And then we can also get into some of the other, other aspects of this report. But as far as that solutions go. What is the idea there of, you know, making sure that everybody is at least on the same page when it comes to information sharing?

Bruce McClintock So one of the one of the very high-level things we recommended was that we thought there should be a deputy secretary defense level coordination effort with the ODNI. Obviously, director of National intelligence that really spanned that divide between DoD policies. And what is generally referred to as the ICC, the intelligence community policy on information sharing. And that that would be a very high-level effort, a working group if you will, that we thought would take a couple of years, but we thought we could be that high level because there are still disagreements within DoD components and uncertainty about their own internal DoD roles and responsibilities. So, because of those two aspects, we recommended a very high-level working group billet.

Eric White We’re talking here with, Bruce McClintock. He’s a senior policy researcher at the Rand Corporation and also the lead of the Rand Corporation Space Enterprise Initiative. So, let’s get a little bit more holistic here. What is the optimal amount of coordination that needs to happen between the U.S. government and its allies when it comes to space? What would be the ideal situation there?

Bruce McClintock I’d say before we get into the actual optimal level of involvement, I think the first step to the United States is just come up with a coherent holistic policy on involving our allies, and that doesn’t exist right now. That contributes somewhat to the capacity do gap problem. Some of the outstanding options, and one of the things that we would say more about holistic approach is it’s not every ally is going to be treated the same way. Right. So, this isn’t about opening the floodgates that we will and sharing everything with every ally. There needs to be a thoughtful approach to how much we’re going to share with people allies. But the US need to be clear upfront about mutual relationship levels so that that’s point one. I would note on that. Once you have decided on those different levels. And by the way, this is what this is a relationship that goes two ways. There are different allies that want different levels of interaction with the United States. Not every ally wants to be fully integrated with beyond states in terms of space operation. And that’s, of course, their national sovereign right. So, both sides need to be clear with each other. Once you establish those different relationship level expectations by ally, then you set up a U.S. structure that addresses those different levels. And the U.S. has made some progress in this area. Some of that starts with just basic information exchange and information sharing at the fully unclassified level. So, this is not always about having a very highly qualified conversation. That makes sense.

Eric White Yeah it does. And you know, not to be you know, two to our own horn or anything. We’ve got a pretty good space program especially you know; we’ve got the Space Force that now is doing its own thing. What exactly does the U.S. need or rely on its allies? You know, the major allies out there? You know, since their space programs may not be as advanced, what exactly are is the U.S. getting from these, allies in the space arena?

Bruce McClintock Two broad terms to describe what the advantages to working with allies, because the US don’t have a very robust, very strong space program when you speak about national security in general. But the first thing I would talk about is coverage of sector one, diversity. And there are other aspects that we could talk about later in life. So, the coverage thing, I think, is the one that is arguably the most important commercial quality, because space is not just about putting things on orbit, it’s also about being able to detect, characterize and track things that are on it. And that requires geographic locations across the globe. Right. So, we’ve been doing a little use of the parameter space power. Now we need geographic access to other territories to be able to improve our space situational awareness network and also our space domain awareness infrastructure. And the same is true for potential future adversaries like China. Like, so we’re out pursuing locations to be in the satellite tracking territory and not China. So that’s one very obvious example. It’s the information sharing like space situational awareness, which is the most fully developed program in the U.S.  The U.S. has a large number of agreements signed with other nations and other entities or SSA Galaxy. So that goes to the coverage piece. But there’s also value in diversity and space capabilities. Things like things that are on orbit but also ground stations become more vulnerable to threats. It’s good to have a diverse set of resources available.

Eric White Are there other areas. And you talked a little bit about it as far as intelligence sharing and coordinating with ODNI, are there other areas where the U.S. government works with its allies, you know, in other arenas that these space policy folks can draw from and see? Okay, so that’s how they do it. You know, maybe we can apply that idea when it comes to, coordination on the space end when you’re up, up higher a little bit.

Bruce McClintock So for our research, we took a pretty close look at a couple of other domains to draw lessons in best practices from those other domains. And the first area that we looked at in particular was nuclear weapons cooperation. For a couple of reasons. We thought that would be an interesting case. First of all, nuclear weapons will probably be most carefully guarded about capabilities, most sensitive, even more so than space capabilities. And so, we wanted to see if there was even any potential share at that level. And there was, in the mid-1950s, we had the United States had exceptional capabilities in that domain, but the Soviet Union was a threat to us. And so, the United States worked closely with the United Kingdom to come up with, neutral …. That were related to nuclear weapons. There was some level of data sharing between the United States and United Kingdom. And there was other, information exchange and coordination that, was important if you consider to be best practices. We also looked at, special operations, any newer area where there has been much touting about being able to cooperate with allies and share information in a way that hasn’t been demonstrated yet in inspection of it. So those are two areas that we looked at. Looked at the two others, two clearly are in charge and sharing opinions, see, and the three primary areas limiting jamming.

Eric White All right. And so yeah, there’s really nothing more that you can say about what’s at stake when you talk about nuclear weapons, but what’s at stake when it comes to space. And, you know, if we don’t get this right as far as working and we’re getting the most that we can out of these relationships with our allies in that domain.

Bruce McClintock I think it, I’ll start at the lowest level of what’s at stake. It’s just a reduction in efficiency. And by that, I mean, in some cases, if allies feel like they can’t depend on the US to share important national security related information about space, then these allies that have significantly more limited resources than the United States has, they feel obligated to invest in their own capabilities for things as simple as space situational awareness, which I talked about earlier, whereas we had a much more robust information sharing, relationship where it was maybe not fully reciprocal, but it share the pieces of information that they could invest, that those resources in other aspects of space security that could be to the benefit of the U.S. So that’s one example. It’s reduced efficiency if we just don’t cooperate as well with our closest allies. If you move up the scale in terms of the significance of the impact, the adverse impact. If we don’t, find ways to become allied by design. There are things like reduced trust and willingness to depend on the United States in times of crisis when it comes to space. So those are now obviously more extreme, but they are package, and I don’t feel like they could count on the United States to share information when the quote unquote chips are down. Then they sometimes say, well, we need to figure out ways to be not only independent but have our own capability. And then there’s less of a need for them to turn to the US on geopolitical policy decisions.

Eric White Wrapping up here, I’ll give you a chance to say anything else on this topic that you think is important for the conversation. But if you could run through also just, you know, some of the other recommendations that you all made, based on what you found in, you know, talking and also what did DoD have to say about this? I guess we could actually ask them and include them in this.

Bruce McClintock Yeah. So I would say as far as what the DoD has to say about this, first of all, you know, I applaud the Department of Defense, starting with, Gerald Whiting for taking an interest in this topic and asking somebody like Rand to look at it because they knew that they were going to get an independent, objective and rigorous analysis of the problem. That we weren’t going to just tell them what they wanted to hear. So not only by initiating process, but then listening to throughout the course of the last couple of years and they provided preliminary insights and recommendations on our final findings and recommendations. I want to applaud, you know, the Department of Defense for being so willing to listen, because it’s not always easy to listen to something that might be tough love. They’re not telling you exactly what you want to hear. And in that vein, I think over the last couple of years, the Department of Defense has taken on some of the recommendation, not all of them by any means, but that’s their prerogative. But they have done things like made expanded the interaction with allies in select venues. So, they have grown and see SPO initiatives that combined space operations in which, you know, that used to be seven nations, it now 10. They’re working on our international space cooperation strategy that was informed by this Rand research. And it’ll also want to applaud a recent announcement from OSD, where they signed a memo that removes a lot of the legacy classification barriers that have inhibited the United States’ ability to collaborate across the U.S. and with allies. Now, that’s a direct example of a recommendation we made, not necessarily because of the Rand report, but in line with the Rand report’s findings and recommendations that the department backs. So, there been great steps taken. There’s a lot more to be done.

WASHINGTON (AP) — The Senate passed a $1.2 trillion package of spending bills in the early morning hours Saturday, a long overdue action nearly six months into the budget year that will push any threats of a government shutdown to the fall. The bill now goes to President Joe Biden to be signed into law.

The vote was 74-24. It came after funding had expired for the agencies at midnight, but the White House sent out a notice shortly after the deadline announcing the Office of Management and Budget had ceased shutdown preparations because there was a high degree of confidence that Congress would pass the legislation and the president would sign it on Saturday.

“Because obligations of federal funds are incurred and tracked on a daily basis, agencies will not shut down and may continue their normal operations,” the White House statement said.

Prospects for a short-term government shutdown had appeared to grow Friday evening after Republicans and Democrats battled over proposed amendments to the bill. Any successful amendments to the bill would have sent the legislation back to the House, which had already left town for a two-week recess.

But shortly before midnight Senate Majority Leader Chuck Schumer announced a breakthrough.

“It’s been a very long and difficult day, but we have just reached an agreement to complete the job of funding the government,” Schumer said. “It is good for the country that we have reached this bipartisan deal. It wasn’t easy, but tonight our persistence has been worth it.”

While Congress has already approved money for Veterans Affairs, Interior, Agriculture and other agencies, the bill approved this week is much larger, providing funding for the Defense, Homeland Security and State departments and other aspects of general government.

The House passed the bill Friday morning by a vote of 286-134, narrowly gaining the two-thirds majority needed for approval. More than 70% of the money would go to defense.

The vote tally in the House reflected anger among Republicans over the content of the package and the speed with which it was brought to a vote. House Speaker Mike Johnson brought the measure to the floor even though a majority of Republicans ended up voting against it. He said afterward that the bill “represents the best achievable outcome in a divided government.”

In sign of the conservative frustration, Rep. Marjorie Taylor Greene, R-Ga., initiated an effort to oust Johnson as the House began the vote but held off on further action until the House returns in two weeks. It’s the same tool that was used last year to remove the last Republican speaker, Kevin McCarthy of California.

The vote breakdown showed 101 Republicans voting for the bill and 112 voting against it. Meanwhile, 185 Democrats voted for the bill and 22 against.

Rep. Kay Granger, the Republican chair of the House Appropriations Committee that helped draft the package, stepped down from that role after the vote. She said she would stay on the committee to provide advice and lead as a teacher for colleagues when needed.

Johnson broke up this fiscal year’s spending bills into two parts as House Republicans revolted against what has become an annual practice of asking them to vote for one massive, complex bill called an omnibus with little time to review it or face a shutdown. Johnson viewed that as a breakthrough, saying the two-part process was “an important step in breaking the omnibus muscle memory.”

Still, the latest package was clearly unpopular with most Republicans, who viewed it as containing too few of their policy priorities and as spending too much.

“The bottom line is that this is a complete and utter surrender,” said Rep. Eric Burlison, R-Mo.

It took lawmakers six months into the current fiscal year to get near the finish line on government funding, the process slowed by conservatives who pushed for more policy mandates and steeper spending cuts than a Democratic-led Senate or White House would consider. The impasse required several short-term, stopgap spending bills to keep agencies funded.

The first package of full-year spending bills, which funded the departments of Veterans Affairs, Agriculture and the Interior, among others, cleared Congress two weeks ago with just hours to spare before funding expired for those agencies.

When combining the two packages, discretionary spending for the budget year will come to about $1.66 trillion. That does not include programs such as Social Security and Medicare, or financing the country’s rising debt.

To win over support from Republicans, Johnson touted some of the spending increases secured for about 8,000 more detention beds for migrants awaiting their immigration proceedings or removal from the country. That’s about a 24% increase from current levels. Also, GOP leadership highlighted more money to hire about 2,000 Border Patrol agents.

Democrats, meanwhile, are boasting of a $1 billion increase for Head Start programs and new child care centers for military families. They also played up a $120 million increase in funding for cancer research and a $100 million increase for Alzheimer’s research.

“Make no mistake, we had to work under very difficult top-line numbers and fight off literally hundreds of extreme Republican poison pills from the House, not to mention some unthinkable cuts,” said Sen. Patty Murray, the Democratic chair of the Senate Appropriations Committee.

Sen. Susan Collins, the top Republican on that committee, appealed to her GOP colleagues by stating that the bill’s spending on non-defense programs actually decreases even before accounting for inflation. She called the package “conservative” and “carefully drafted.”

“These bills are not big spending bills that are wildly out of scope,” Collins said.

The spending package largely tracks with an agreement that then-Speaker McCarthy worked out with the White House in May 2023, which restricted spending for two years and suspended the debt ceiling into January 2025 so the federal government could continue paying its bills.

Shalanda Young, director of the White House Office of Management and Budget, told lawmakers that last year’s agreement, which became the Fiscal Responsibility Act, will save the federal government about $1 trillion over the coming decade.
